Purchase and Sale Terms

1. General provisions

These Purchase & Sale Terms govern the rights, obligations and responsibilities of MB Care by Yuliya (the Seller) and the customer (the Customer) when purchasing products from the online store lozak.store.

By using this Website and placing an order, the Customer confirms that they have read, understood and agreed to comply with these Terms.

2. Conclusion of the contract

  • The purchase contract is considered concluded when the Customer places an order and the Seller confirms it by email.
  • All orders are treated as the Customer’s intention to purchase products in accordance with these Terms.

3. Customer rights

  • The Customer has the right to purchase products on the Website in accordance with these Terms and applicable laws of the Republic of Lithuania.
  • The Customer has the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason, in accordance with our Returns & Refund Policy.
  • The Customer has the right to request replacement, refund or other remedies for defective, damaged or non-conforming products in accordance with applicable law.

4. Customer obligations

  • To provide accurate personal, billing and delivery information.
  • To ensure that they are authorised to use the selected payment method.
  • Not to use the Website for unlawful, fraudulent or abusive purposes.
  • To review product descriptions, sizing, care instructions and other relevant information before placing an order.

5. Seller rights

  • To suspend or limit operation of the Website temporarily or permanently for technical, security, maintenance or other justified reasons.
  • To refuse, cancel or not fulfil an order if the Customer violates these Terms, provides incorrect information, fails to complete payment, or if fraud is suspected.
  • To change product prices, promotions, availability or delivery terms by publishing the relevant information on the Website.

6. Seller obligations

  • To make reasonable efforts to ensure that products comply with applicable quality and safety requirements.
  • To fulfil confirmed orders in accordance with fair commercial practice.
  • To inform the Customer if an order cannot be fulfilled and refund any amounts paid where applicable.

7. Liability

  • The Customer is responsible for the accuracy of the information provided. The Seller is not liable for losses resulting from incorrect, incomplete or outdated information supplied by the Customer.
  • The Seller is not liable for delays, losses or failures caused by circumstances beyond its reasonable control, including courier delays, third-party service failures, technical disruptions or force majeure events.
  • Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

8. Intellectual property

All content on the Website, including but not limited to illustrations, product designs, character artwork, photographs, descriptions, logos, brand elements, layout and other materials, belongs to MB Care by Yuliya or is used lawfully.

Copying, reproducing, distributing, publishing or using any content for commercial purposes without prior written permission is prohibited.

9. Dispute resolution

Any disputes should first be resolved through direct communication and negotiation. If no agreement is reached, the dispute shall be resolved in accordance with the laws of the Republic of Lithuania before the competent authority or court.

Consumers may also contact the Lithuanian Consumer Rights Protection Authority (VVTAT) or use the European Commission’s ODR platform.

10. Governing law

These Purchase & Sale Terms and all related rights and obligations shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.

11. Final provisions

The Seller reserves the right to amend these Terms by publishing an updated version on the Website. The new version becomes effective from the date of publication and applies to orders placed after that date.
